1. Dear Guests, we have almost all the ingredients we need for the ball. Only one extremely important one is still missing—and that’s you! Together with you, we’ll spend a wonderful day at the ball. Please come in large numbers, because only you can add the right flavor and make the coffee truly enjoyable. In the following sections, you’ll find contractual information governing attendance at the ball.

2. Please note that the ball may be held at different times and in different venues each year, depending on how the club organizes it. Ticket prices for the ball, as well as ticket categories (e.g., standard rate, reserved seating, student tickets), may also change from year to year. The ticket prices currently listed on the website, at the ticket office, or otherwise announced apply to the ball currently being advertised. Student tickets may only be purchased upon presentation of a valid student ID; only one ticket per ID is available for individuals up to age 26. Prices for reserved-seating tickets depend on the desired venue.

3. The information provided on the club’s website, the ball’s website, Facebook, or other media is carefully reviewed and regularly updated. We reserve the right to make changes and correct errors. Access to and use of the website, as well as any information contained therein or referenced therein, are the sole responsibility of the user. Links to other websites are not part of our own information, and we assume no liability or responsibility for the content or changes to the content on linked sites. The use of our content (texts, logos, photos, etc.) and its reproduction, distribution, transmission, and presentation for commercial purposes is prohibited.

4. The personal data required for orders or inquiries, such as name, phone number, or email address, is used exclusively for the purposes of contract fulfillment in accordance with Article 6(1)(b) of the GDPR (including accounting). Additional information on data protection in accordance with Article 13 of the GDPR can be found on our website.

5. Ticket orders are binding. Once you have placed your order, you will receive an order confirmation. We expressly do not grant any right to cancel, exchange, or otherwise withdraw from the contract. Mandatory statutory remedies remain unaffected. The services offered are leisure services that are to be provided at a specific time or within a precisely specified period. Therefore, when entering into contracts via distance selling, you are not entitled to the special statutory right of withdrawal applicable to distance sales transactions.

6. The organizer assumes no liability whatsoever for expenses directly or indirectly related to the (now void) reservation (e.g., no reimbursement of travel cancellation fees).

7. For payments made with credit or debit cards, the terms and conditions of the payment service provider apply. The ball tickets will not be issued or mailed until the payment has been received.

8. The ordered prom tickets will be delivered either by mail, email, or download, or an option to pick them up in person (by dropping them off at the entrance on the day of the prom) will also be offered. Postage and shipping fees will be charged for delivery; these are displayed at the time of ordering. Delivery dates are non-binding unless the delivery date is expressly designated as a binding date.

9. The valid ball tickets are those that are accepted first upon entry based on their unique identification. Subsequent ball tickets with identical admission authorization—e.g., copied tickets—are automatically invalidated upon the entry of the first ticket holder. The customer may make only one printed copy of each ball ticket.

10. The resale of ball tickets for commercial purposes is not permitted.

11. Ball tickets cannot be returned under any circumstances. Paid ball tickets cannot be returned or exchanged. No refunds will be issued for ball tickets that were not used or were used only partially (e.g., due to arriving late).

12. The club is not obligated to notify you of any cancellations, postponements, or changes of venue. However, we will make every effort to notify all ball ticket holders—provided we have their contact information and it is accurate—as far as possible. The club assumes no liability for travel, hotel, or similar expenses incurred in connection with a canceled, postponed, or rescheduled ball. In the event of the ball’s cancellation, a refund of the ticket price can only be requested directly from the organizer; the relevant procedures will be communicated via the ball’s website.

13. The organizer handles reservations, bookings, and the provision of ball tickets. The prices listed on the website or in other media are final prices and include all fees and charges.

14. Ball tickets can be purchased in the online store. Before submitting your order, you can change, view, or deselect the selected ball tickets at any time, or cancel the purchase process. After placing an order by clicking the “Place Order” button, you are submitting a binding offer to purchase the items in your shopping cart. The total price of the order is due immediately, depending on the available payment methods. The organizer reserves the right not to support certain payment methods. Order confirmations do not constitute acceptance of the binding offer. The contract is not concluded until a separate invoice or the ball tickets are sent.

15. Reservations for ball tickets are generally only possible upon payment of a reservation fee.

16. There is no right to return or exchange purchased ball tickets, even in the event of illness, cast changes, or program changes.

17. Only a limited number of ball tickets are available at any given time. Tables and boxes are also in limited supply.

18. There is no right of revocation or withdrawal for ball tickets based on consumer status as defined by the KSchG. Furthermore, you have no right of withdrawal under the FAGG, particularly since the ball is classified as a service related to recreational activities.

19. When attending the ball, you are subject to the house rules of the venue, which is usually the Hofburg in Vienna. You must follow the instructions of the staff and the ball attendants at all times. You may be removed from the ball if you violate the house rules, or, for example, if you have taken a seat for which you cannot present a valid ball ticket, or if you have not behaved or dressed appropriately. Therefore, please observe the dress code (ball gown or floor-length evening gown for ladies; tailcoat with decorations, tailcoat, tuxedo, or gala uniform, along with tailcoat or tuxedo bow tie, for gentlemen). The Ball Committee reserves the right to deny entry to anyone not dressed appropriately.

20. The start and end dates of the raffle ticket sale will be announced. The drawing will be conducted at random. Prizes cannot be redeemed for cash or exchanged for other items. Unclaimed prizes will be forfeited in favor of the organizer.

21. Audio and video recordings made for commercial purposes during the ball require the club’s consent. In the event of a violation, club staff or the club itself is authorized to confiscate recording devices and/or delete recorded material.

22. Bringing your own food and beverages is prohibited. Smoking is permitted only in designated areas. Pets are not allowed.

23. Photos and videos will be taken and used for media purposes in accordance with Article 6(1)(f) of the GDPR, based on the club’s legitimate interest. By accepting these Terms and Conditions, you grant the club, without compensation, the right to use the recordings you make during or in connection with the event, without any temporal or geographical restrictions, for commercial use in any medium and for any current or future technical process, provided that such use does not unduly infringe upon your personal interests (right of use). If you find yourself in a photo or video and object to its use, please contact the club.

24. Items may be checked with the coat check staff for a fee. The organizer is liable for mixed-up, damaged, or lost items only in cases of willful misconduct or gross negligence. The terms and conditions posted at the coat check, as well as the venue’s house rules, apply.

25. The organizer shall be liable to you only in the event of death, bodily injury, or harm to health, as well as for other damages resulting from a willful or grossly negligent breach of duty (including by agents). Any further liability is excluded.

26. The place of performance is the organizer’s registered office. Austrian law applies, excluding the provisions of the UN Convention on Contracts for the International Sale of Goods. If the transaction is not a consumer transaction, it is agreed that the court with jurisdiction at the club’s registered office shall have jurisdiction to resolve any legal disputes. The European Commission offers the option of dispute resolution via an online platform it operates. This platform can be found at the external link https://consumer-redress.ec.europa.eu/index_de. The club does not participate in dispute resolution proceedings before consumer arbitration boards.
